Le cas du partage avec soulte
Deux héritiers recueillent, dans une succession, une vigne louée par bail à long terme. Ils bénéficient de l’exonération, deux ans plus tard, ils mettent fin à l’indivision : l’un d’eux se voit attribuer la vigne à charge de régler une soulte à l’autre. Ce partage ne remet pas en cause l’exonération appliquée lors de la succession si l’héritier attributaire de la vigne la conserve effectivement jusqu’au terme des 5 ans. L’héritier qui reçoit la soulte a donc cédé sa part, mais il conserve néanmoins le bénéfice de l’exonération… à condition que l’attributaire du bien respecte le délai de conservation[adrotate group="7"]
